01. Agreement to Terms

By visiting dynmxllc.comor hiring DYNMX LLC for custom websites, mobile apps, or App Store Optimization (ASO), you agree to these Terms & Conditions. DYNMX LLC is owned and operated by Brandon Burgan.

02. Engineering & Development Services

We agree to perform services in accordance with individual Statement of Work (SOW) documents agreed upon by both parties. Any additions, adjustments, or changes to the project scope must be formally approved in writing.

03. SMS Messaging Program

A2P SMS Program Terms

These terms govern the Application-to-Person (A2P) text messaging program operated by DYNMX LLC.

Program Description

When you opt in by submitting our contact form with your phone number and checking the SMS consent box, you agree to receive non-marketing text messages from DYNMX LLC. These messages may include:

• Inquiry responses: Replies to questions or proposal requests submitted through the website.
• Consultation & project coordination: Scheduling, rescheduling, confirmations, reminders, kickoff logistics, and related coordination for discovery calls, consultations, and project milestones.
• Project status updates: Updates connected to an existing inquiry, project, or user-submitted request.
• Customer support follow-ups: Help, clarification, or support related to your inquiry, project, or services.

This SMS program is intended for non-marketing communications unless DYNMX LLC separately creates and receives approval for a compliant marketing SMS opt-in and campaign.

Message Frequency

Message frequency may vary. You may receive multiple messages depending on the nature of your inquiry, scheduling needs, project status, or engagement with DYNMX LLC.

Costs

Message and data rates may apply based on your mobile carrier plan. DYNMX LLC does not charge for SMS messages, but your carrier may charge message or data fees.

Opt-Out

Reply STOP to any text message at any time to cancel. You may receive one final confirmation message confirming that you have been unsubscribed.

No Third-Party Sharing

Carrier Liability

Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your mobile carrier and network operator and is outside the control of DYNMX LLC.

Age Requirement

You must be 18 years of age or older to use this SMS service. By opting in, you confirm that you are at least 18 years of age or have the appropriate consent required by applicable law.

04. Intellectual Property (IP) & Ownership

• Upon receipt of full and final payment for completed services, DYNMX LLC transfers 100% of the repository code, designs, and database structures developed specifically for your project.
• DYNMX LLC retains all rights to its pre-existing library frameworks, modules, templates, and general design elements utilized during the development.
• All content on this website, including text, images, logos, graphics, design elements, and other materials, is owned by DYNMX LLC or used with permission and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from website content without express written permission.

05. App Store Optimization (ASO) & Search Ranking

While DYNMX LLC uses industry-standard methodologies to optimize keyword placement and organic metadata, search engines and App Store algorithms (Apple App Store / Google Play Console) are volatile. We cannot guarantee specific rank placement or permanent download multipliers, as store algorithms fluctuate.

06. Payment and Cancellation

Client agrees to project payments aligned with project milestones described in each SOW. Milestone payments are non-refundable once the associated deliverables have been built and handed over. Delayed payments may pause development timelines.

07. Website Use

By accessing or using our website, you agree to:

• Use the website only for lawful purposes.
• Not attempt to gain unauthorized access to any portion of the website, forms, systems, or related services.
• Not use the website in any way that could damage, disable, overburden, or impair its functionality.
• Not submit false, misleading, fraudulent, or unauthorized information through our contact forms.

08. Limitation of Liability

To the fullest extent permitted by law, DYNMX LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the website, forms, communications, or services, including but not limited to app store suspensions, hosting server outages, database crashes, or loss of client revenue, even if we have been advised of the possibility of such damages. Our total liability is capped at the amount paid by the client for the specific service under review.

Our website may contain links to third-party websites, tools, platforms, or resources. These links are provided for convenience only. DYNMX LLC does not control and is not responsible for third-party websites, content, privacy practices, or services.
